5. Shipping & Delivery

5.1 Shipping Availability

5.2 Shipping Costs & Methods

All shipping timelines are non-binding estimates based on usual transit times, do not constitute guarantees or conditions of sale, and may vary due to unforeseen or uncontrollable factors (such as natural disasters, carrier disruptions, governmental actions, or other force majeure events).

5.3 Delivery Time

  • If delivery is delayed beyond 3 business days of the estimated delivery dates, we will notify you proactively.
  • A delay is defined as the failure to make the first delivery attempt within 3 business days after the estimated delivery date.
  • Delays do not include:
  • Situations where the customer provides incorrect or incomplete shipping information.
  • Delivery disruptions caused by force majeure events such as natural disasters, strikes, or governmental actions.
  • Delivery delays resulting from the recipient being unavailable to accept the order at the specified delivery address.
  • In the event of a qualifying delay, we may decide, in our sole discretion, to award you store credit in Thai Baht (THB) equal to twice the amount paid, capped at a maximum of 5,000 THB, valid for 365 days from the date of purchase. This credit is your sole and exclusive remedy for any shipping delay.
  • You are solely responsible for ensuring accurate address, contact, and recipient details. We disclaim liability for shipments that are returned, lost, or misdelivered due to incomplete or inaccurate information you provide.
  • We shall not be liable for any and all damages, losses, or expenses of any kind arising from delayed delivery where such delay falls outside our direct control. Once the carrier confirms delivery, all risk of loss or theft passes to you.

6. Receiving Orders, Returns & Refunds

6.1 Inspection Upon Delivery

  • Immediately inspect the condition of products upon delivery. If there are any apparent anomalies (e.g., damage, missing items, or discrepancies), you must document and report them to both the carrier (if applicable) and us within 24 hours of delivery. Retain all original packaging until any claim is resolved.

6.2 Refunds

  • We maintain a strict no-refund policy. We do not provide refunds under any circumstances, including dissatisfaction with the product, interpretation of results, or a change of mind once the order has shipped. All shipping or handling charges, if any, are non-refundable.

6.3 Exchanges

If we, at our sole discretion, confirm the product was damaged or defective upon arrival, we will replace it only. We will not process refunds.   • Our products are not marketed as, nor classified as, medical or in vitro diagnostic (IVD) devices under Thai FDA regulations. Our testing kits are prevention tools. They are therefore not in any way medical products or devices. There are no prescribed marks or labels for IVD on primary and secondary packagings, as well as on instructions for use. They bear no official certification for medical usage, and we make no warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Use of our products is entirely at your own risk, and we disclaim any liability for decisions or outcomes arising from reliance on test results.

7.2 Accuracy of Test Results

  • No test is 100% accurate, and factors like user error, contamination, or device malfunction can lead to false positives or false negatives. We recommend confirmatory testing (e.g., GC/MS) for definitive results. We disclaim liability for any decisions or outcomes based on preliminary results from our products.

7.3 Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT:

LIABILITY DISCLAIMER: NEITHER HAPPY TEST SHOP NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR ANY AND ALL DAMAGES, LOSSES, OR EXPENSES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR ANY OTHER LOSS ARISING OUT OF OR RELATING TO THE PRODUCTS OR THESE T&C;
  2. LIMITATION OF TOTAL LIABILITY: IN NO EVENT WILL HAPPY TEST SHOP’S TOTAL LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE PURCHASE PRICE OF THE PRODUCT(S) AT ISSUE OR AN AMOUNT OF ONE THOUSAND (1,000) THAI BAHT, WHICHEVER IS LESS;
  3. Scope of Application: The foregoing limitations apply even if we have been advised of the possibility of such damages and regardless of any failure of essential purpose of any limited remedy.

7.4 Force Majeure

  • We are not responsible for any failure or delay in performance caused by events beyond our reasonable control (e.g., acts of God, war, natural disasters, labor disputes, governmental actions, or internet/telecommunication failures).

7.5 Governing Law and Dispute Resolution

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand, without regard to conflict-of-laws principles. Disputes shall be resolved exclusively through arbitration in Bangkok, Thailand, under the rules of the Thailand Arbitration Institute (TAI).
  • Individual Proceedings Only: You agree to resolve disputes solely on an individual basis, and you waive any right to pursue or participate in class or collective actions.
  • Costs and Fees: To the fullest extent permitted by law, all arbitration costs, including legal fees, shall be borne exclusively by the non-prevailing party, irrespective of any finding of partial liability or fault on the part of Happy Test Shop.
  • Confidentiality: All arbitration proceedings, including associated documents and outcomes, shall be kept strictly confidential, unless disclosure is required by law.
  • Binding and Final: The arbitral award shall be final and binding on all parties, and may be entered and enforced in any court of competent jurisdiction.

8. Indemnification

You agree to defend, indemnify, and hold harmless Happy Test Shop, its affiliates, and their respective officers, employees, and agents, to the fullest extent permitted by applicable law, from and against all claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys’ fees and other dispute-resolution costs) arising from or related to:

  1. Your misuse of our products;
  2. Your breach of these T&C;
  3. Your violation of applicable laws or regulations;
  4. Any infringement of third-party rights caused by your actions or omissions; or
  5. Any other conduct by you that results in a claim against Happy Test Shop.

Happy Test Shop reserves the right, at its sole discretion, to assume the exclusive defense and control of any matter otherwise subject to your indemnification obligation, and you agree to cooperate fully. No settlement shall bind or impose any obligation on Happy Test Shop without our prior written consent.

9. Intellectual Property
